General Terms and Conditions

1. Scope and Acceptance of Terms

These General Terms and Conditions govern access to and use of BrainPandora, including its universe, interactive experiences, user accounts, community features, user-generated content, artificial intelligence features, and promotional reward systems.

By creating a BrainPandora account, users expressly agree to these General Terms and Conditions and confirm that they have been informed of the Privacy Policy. Registration requires an affirmative action through an unchecked acceptance checkbox. The applicable Terms are accessible before registration and remain available for subsequent reference.

The Privacy Policy provides information about personal data processing and is not itself a contractual consent to all processing activities. Where separate consent is legally required, it will be requested independently.

These General Terms, the Community Guidelines, and applicable promotional rules govern participation in BrainPandora to the extent validly incorporated into the contractual relationship. Additional conditions may apply to specific services, competitions, or paid products and will be communicated separately. Mandatory statutory rights remain unaffected.

2. Platform Description & Voluntary Participation

BrainPandora is a creative, interactive entertainment and community platform in which content, fictional worlds, experiences, and contributions are interconnected through signals, creators, tags, and relationships.

Content may be created by users, artificial intelligence, or the platform operator. BrainPandora does not guarantee the accuracy, completeness, originality, suitability, availability, or continued publication of individual content items. Content may be fictional, experimental, automatically generated, or otherwise unsuitable for reliance in professional or consequential decisions.

Registration and participation in BrainPandora are voluntary. Registration and participation do not establish any entitlement to particular content, promotional opportunities, sponsorships, Discovery Boost levels, rewards, or continued availability of individual features. BrainPandora may introduce, modify, restrict, suspend, or discontinue optional features for legitimate operational, security, legal, technical, or economic reasons, subject to applicable contractual and statutory obligations. No user is guaranteed selection for sponsorship, promotional visibility, reward allocation, or participation in a particular promotional event.

3. Registration and Accounts

Registration is free unless a particular paid service is expressly identified. Users must provide accurate registration information and maintain the confidentiality and security of their accounts.

Accounts are personal and must not be sold, transferred, shared for abuse, or used to circumvent platform restrictions. Users are responsible for activity performed through their accounts to the extent permitted by applicable law.

BrainPandora may apply reasonable technical measures to prevent unauthorized access, duplicate accounts, spam, fraud, and automated abuse. Registration does not guarantee permanent access to any particular feature.

4. User-Generated Content

Users may publish text, images, videos, audio, games, prompts, interactive experiences, links, and other supported content. Users are responsible for ensuring that their submissions comply with applicable law and these Terms.

By submitting content, users confirm that they possess the rights and permissions necessary to upload, publish, and authorize its use on BrainPandora. Users must not knowingly publish content that infringes copyrights, trademarks, privacy rights, personality rights, confidentiality obligations, or other protected rights.

Users retain their rights in their original content. By publishing content, users grant BrainPandora a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, format, transcode, display, distribute through platform features, and technically process that content as reasonably necessary to operate and present BrainPandora. This licence includes the technical creation of previews, thumbnails, and compatible representations. The licence does not transfer ownership to BrainPandora.

Users remain responsible for obtaining any necessary rights relating to third-party materials contained in their submissions.

5. Artificial Intelligence Content

BrainPandora may provide content generated or assisted by artificial intelligence. AI-generated content may contain inaccuracies, fictional statements, unexpected results, or similarities to existing works.

Users are responsible for reviewing AI-generated materials before publishing, distributing, or relying on them. BrainPandora does not guarantee that AI-generated material is unique, free from third-party rights, or suitable for commercial exploitation. Applicable AI provider conditions and statutory requirements may impose additional restrictions.

6. Prohibited Activities

Users must not:

Upload or distribute unlawful, fraudulent, infringing, or deceptive content.
Harass, threaten, impersonate, or unlawfully disclose information about others.
Distribute malware, phishing links, or attempt unauthorized access to systems.
Manipulate engagement statistics, game results, Discovery Boost, or reward allocation.
Operate unauthorized bots, automated accounts, or coordinated reward-farming systems.
Circumvent security, moderation, or account restrictions.
Misrepresent sponsorships, affiliations, ownership, or reward authenticity.
Use BrainPandora to facilitate unlawful transactions or activities.

7. Moderation, Discretionary Enforcement and Proportionate Restrictions

BrainPandora may investigate suspected violations of applicable law, these Terms, Community Guidelines, promotional rules, or platform security requirements. Depending on the circumstances, proportionate measures may include warnings, content removal, restricted visibility, temporary suspension, exclusion from promotional features, or permanent account termination.

BrainPandora exercises its moderation powers in a proportionate manner, considering the context, seriousness, repeated nature of violations, and impact on other users. Immediate action may be taken where reasonably necessary to address serious misconduct, fraud, security threats, unlawful content, or other important grounds.

Where legally required under the EU Digital Services Act (DSA) and applicable law, affected users will receive reasons for moderation decisions and information about available review or complaint procedures.

Users and visitors may report potentially unlawful or rights-infringing content through the platform's Reporting Mechanism or by contacting brain@brainpandora.com.

8. Community Responsibility

Users are responsible for their own statements, contributions, and interactions. BrainPandora does not automatically endorse opinions or claims expressed by users. The platform may moderate contributions but does not guarantee that all content has been reviewed before publication. Reports concerning unlawful content, impersonation, intellectual-property violations, or other harmful conduct will be assessed in accordance with applicable legal requirements.

9. Promotional Rewards and No Guaranteed Entitlement

Discovery Boost, treasure encounters, sponsor rewards, vouchers, gift codes, coupons, and other promotional benefits are voluntary promotional features governed by the separate Discovery Boost & Treasure Policy.

Participation does not guarantee the discovery, allocation, availability, delivery, validity, acceptance, or successful redemption of any reward. Discovery Boost has no monetary value and does not constitute currency, property, stored value, a payment instrument, or an account credit. It cannot be exchanged for cash or purchased.

Before a reward has been validly allocated under the applicable promotional rules, users have no entitlement to receive any particular prize, voucher, gift, or financial benefit. A valid allocation or claim may establish rights under the applicable promotion terms and mandatory law. BrainPandora does not reserve a general right to revoke validly acquired claims arbitrarily.

BrainPandora may reject or remove promotional offers and suspend future allocations for legitimate reasons, including suspected fraud, inaccurate descriptions, expired inventory, unlawful content, sponsor withdrawal, or security concerns.

Promotional Retention & Expiration Lifecycle: Expired promotional treasures cannot be discovered or claimed after their disclosed expiration date. All promotional treasures that have been discovered (whether claimed or unclaimed) as well as expired treasures are retained in platform records, user dashboards, and sponsor past reward archives for a maximum lifecycle of six (6) months (180 days). Upon reaching six months from discovery, claim, or expiration, such treasures are automatically and permanently deleted through automated platform maintenance routines.

10. Third-Party Sponsors, Vouchers and Gift Codes

BrainPandora may display promotional benefits supplied by independent sponsors, merchants, creators, contributors, and other third parties.

Unless expressly identified otherwise, BrainPandora is not the issuer, seller, merchant of record, redemption operator, or contractual provider of third-party products and services. Independent sponsors and issuers are responsible for the accuracy of their offers, the validity of codes they supply, and the fulfilment of obligations arising from their own products, services, and redemption arrangements.

Users are responsible for reviewing and complying with the terms, eligibility requirements, expiration dates, geographical restrictions, age restrictions, account requirements, and redemption instructions of the applicable third-party provider. Using an external voucher, gift code, coupon, or promotional link may establish a separate contractual relationship between the user and the third-party provider. BrainPandora is not a party to that separate transaction unless expressly stated otherwise.

11. Promotional Face Values and External Redemption

A displayed promotional amount, such as “$100 Gift Card”, “€50 Voucher”, or “20% Discount”, describes the advertised promotional benefit or the value represented by the relevant third-party offer.

Such amounts do not represent money deposited with BrainPandora, an account balance maintained by BrainPandora, or a promise by BrainPandora to pay the displayed amount in cash. The actual redemption value, currency, eligibility, available products, restrictions, expiration, and applicable conditions are determined by the relevant issuer and the disclosed offer terms.

BrainPandora does not independently guarantee that a third-party promotional code can be exchanged for cash, used without restrictions, or redeemed outside the issuer's applicable terms. Displayed values must not be knowingly misleading. BrainPandora may correct or remove inaccurate promotional descriptions.

12. Sponsor Review and External Links

BrainPandora may review sponsor submissions, promotional descriptions, destination URLs, and redemption instructions before publication or following reports. BrainPandora reserves the right to reject, disable, investigate, or remove promotional content where justified by legal, security, integrity, or platform-quality concerns.

Such review does not constitute certification, insurance, financial verification, endorsement, or a guarantee of the continued reliability of an independent sponsor.

Users should exercise appropriate caution when visiting external websites, creating third-party accounts, disclosing personal information, making purchases, or submitting payment details. Users should not provide passwords, financial credentials, or sensitive personal information to an external provider unless they independently trust that provider and understand the transaction.

13. Third-Party Transactions and Risks

External websites, products, services, subscriptions, downloads, and redemption systems are operated independently from BrainPandora. Users decide whether to access or use third-party services and are responsible for complying with the applicable third-party contractual conditions and legal requirements.

BrainPandora does not control independent third-party systems and cannot guarantee their availability, security, pricing, product quality, delivery performance, or contractual decisions. To the extent permitted by law, BrainPandora is not responsible for losses arising exclusively from independent third-party conduct outside BrainPandora's contractual obligations and legal responsibility.

Nothing in these Terms excludes liability for BrainPandora's own legally attributable misconduct, breach of applicable duties, or other liability that cannot lawfully be excluded.

14. Changes to Promotional Features & Terms

BrainPandora may prospectively modify or discontinue promotional features for legitimate operational, legal, security, technical, or economic reasons. This may include changes to Discovery Boost calculations, reward probabilities, eligible activities, sponsor availability, promotional inventory, and participation requirements.

Temporary interruptions may occur. There is no guarantee of uninterrupted availability. Changes affecting existing contractual rights will be handled in accordance with applicable law. Previously established valid claims and mandatory statutory rights remain unaffected.

15. Liability

BrainPandora is liable without limitation for damage caused intentionally or through gross negligence, and for injury to life, body, or health resulting from a negligent breach of duty. Liability under mandatory statutory provisions, including applicable product liability law and mandatory consumer protection rights, remains unaffected.

In cases of ordinary negligence involving essential contractual obligations (obligations whose fulfillment is essential to the proper performance of the contract and on whose compliance the user may regularly rely), BrainPandora's liability is limited, where legally permissible, to foreseeable damage typical of the contract. For other cases of ordinary negligence, liability is excluded to the extent permitted by applicable law.

These limitations also apply, where legally permissible, to legal representatives and persons employed in the performance of obligations (Erfüllungsgehilfen). BrainPandora does not guarantee the accuracy, suitability, commercial usefulness, or uninterrupted availability of user-generated, AI-generated, or independent third-party content. Users remain responsible for their own unlawful conduct, contractual commitments with third parties, and misuse of external services. These limitations do not exclude statutory rights, mandatory duties, or liability that cannot lawfully be limited.

16. Account Restrictions, Ordinary Termination and Termination for Good Cause

Users may delete their account or terminate their participation at any time, subject to applicable contractual and statutory requirements.

BrainPandora may terminate an indefinite, free account relationship by giving reasonable notice, subject to applicable law and existing contractual rights. Immediate termination without notice remains possible for good cause (such as serious or repeated violations of these Terms, fraud, security threats, or unlawful conduct).

Account termination does not automatically extinguish previously established valid reward claims, subject to applicable law. Existing legal obligations, statutory rights, and required record retention remain unaffected.

17. Applicable Law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG), subject to mandatory consumer protection provisions of the country in which the consumer has their habitual residence that cannot lawfully be derogated from by agreement. Statutory jurisdiction rules remain unaffected.
